Real Estate | Planning & Environment
We provide planning services for a variety of clients – developers, landowners and other parties involved in the planning process. We also provide advice and services for ancillary matters, including highways issues and the registration of commons and village greens.
We appreciate that clients require more than simple interpretation and application of policy. Our aim is to provide a commercially workable outcome for clients that both enables them to pursue their commercial or personal objectives while complying as far as practicable with policy.
Major planning applications involve a range of consultants, including highways and services engineers, environmental consultants, housing advisors and designers. We appreciate the importance of working together with other relevant professionals to achieve the best outcome for the client.
Sector experience
A considerable part of our planning practice involves work for developers in the house-building industry. We have many years’ experience in negotiating planning agreements under Section 106 of the Town and Country Planning Act 1990, and are familiar with both policy and practical issues – balancing the requirement to provide affordable housing with the need to maintain viability, and agreeing a framework that will not prevent the scheme proceeding should difficulties be encountered in discharging the planning obligations through matters outside the developer's or landowner’s control.
We have considerable experience in dealing with contested village green applications, principally on behalf of objectors to registration. We appreciate the importance of diligent investigations to produce evidence to be put before the inspector at an inquiry to support any attempt to defeat an application for registration.
