Supreme Court rules Uber drivers entitled to workers' rights
BV & Others v Aslam & Others
The Supreme Court has today confirmed that Uber drivers are workers. Tribunals should look at the reality of the relationship and look past what the documentation says and in this case Uber drivers were not self-employed.
Minimum wage is payable for the entire period from when they switch on the App. to when they switch it off not just when they have a fare paying ride.
Drivers will be able to claim 2 years back pay or £25,000 whatever is the higher sum in the Tribunals or 6 years back pay in the county court.
